The ‘Conscience Clause bill’ was launched on 8/12/2014 by Paul Givan MLA (see http://dev.mydup.com/images/uploads/publications/Freedom_of_Conscience_Consultation_Document_Final.pdf) . If passed, this bill will be a license to discriminate against lesbian, gay and bisexual people. Mr Givan claims his bill will create reasonable accommodation for those of religious belief to deny goods and services to LGB people when it ‘promotes or facilities same-sex relations’.
What this could mean in practice is;
- Restaurants could deny a same sex couple a table as could be facilitating same sex relations
- A mortgage provider could deny a mortgage to a same sex couple as it would be facilitating same-sex relations
- Hoteliers could deny a room to a same sex couple as it would be facilitating same sex relations
The current legislation, known as the Equality Act (Sexual Orientation) Regulations (Northern Ireland) 2006, prohibits discrimination on the basis of sexual orientation and was introduced in 2006.
A conscience clause that allows businesses to discriminate is counterproductive, is not good for business or attracting investors to Northern Ireland. This would set Northern Ireland out on a limb as the only place in the UK that allows discrimination against LGB people in the provision of goods, facilities and services.
